These Terms of Service (“Terms”) govern access to PartyTopiie.com and services provided by PLI LLC (“PartyTopiie,” “we,” “us,” or “our”). By using the Service or placing an order, a user agrees to these Terms and the policies incorporated below. If applicable law requires a separate affirmative acceptance, continued browsing alone is not acceptance.
1. Eligibility and Authority
A user must be at least 18 years old or use the Service with the involvement and authorization of a parent or legal guardian who agrees to these Terms. A person accepting for a business represents that they are authorized to bind it.
Submit Your Party is available only to adults who can grant all required permissions. Seller eligibility and seller services are governed by the separate Seller Agreement.
2. Global Access and Country-by-Country Availability
PartyTopiie.com may be viewed worldwide. PLI LLC currently directs its active marketing to the United States and does not actively conduct localized advertising, local-language search marketing, or region-specific promotional email campaigns outside the United States.
Checkout, paid services, seller participation, and some submission features are enabled country by country. Availability depends on supported payment, indirect-tax, sanctions, privacy, consumer-protection, and operational controls. Access to a page, price, Tool, or form does not guarantee that the feature is currently available in the user’s country. A current restriction is not a permanent refusal to serve that country.
Non-U.S. buyers may purchase standard downloads and custom orders whenever PartyTopiie has enabled checkout for their country. PartyTopiie may block or cancel a transaction that would violate law or an applicable country restriction and will refund an amount already charged for a canceled order.
3. PartyTopiie’s Role and Transaction Types
On-Site Digital Orders
PLI LLC is the contracting seller and seller of record for every digital product or digital customization service purchased through PartyTopiie checkout, regardless of the buyer’s or fulfillment provider’s country. PLI LLC controls the buyer-facing listing, checkout, payment, electronic delivery, support, Purchase Protection, and refund process.
An approved independent provider may create a custom file behind the platform. That provider performs fulfillment services for PLI LLC and does not contract directly with the buyer. PLI LLC remains responsible for the buyer relationship.
External Ready-Made Products
PartyTopiie currently participates only in the Amazon Services LLC Associates Program. A disclosed Amazon link may send the user to an Amazon site, where Amazon or the seller identified on the Amazon listing—not PLI LLC—controls the off-site price, availability, checkout, payment, shipping, cancellation, return, warranty, and product support. PartyTopiie may earn a commission as described in the Affiliate Disclosure.
4. Digital Products Only
Products sold through PartyTopiie checkout are digital files or digital customization services delivered electronically. PartyTopiie checkout does not sell physical products or include printing, cutting, assembly, or shipping.
A mockup showing a design on a shirt, mug, cake topper, sticker, or other object demonstrates a possible use and does not mean the physical item is included.
Before ordering, the buyer should review the file formats, included components, customization requirements, intended use, delivery timing, and stated limitations.
5. Orders, Payment, and Taxes
An order is an offer to purchase. PLI LLC accepts the order when PartyTopiie confirms it and begins performance or makes the purchased digital product available. PartyTopiie may reject or cancel an order for a pricing or listing error, suspected fraud, rights concern, unavailable service, unsupported request, country restriction, unlawful purpose, or inability to fulfill. If PLI LLC cancels after payment and no equivalent remedy accepted by the buyer is provided, it will refund the affected amount.
The buyer must provide accurate billing, contact, country, and order information and authorizes PLI LLC and its payment provider to charge the checkout total, including clearly disclosed tax and an optional add-on the buyer actively selects.
As seller of record, PLI LLC is responsible for calculating, collecting, reporting, and remitting sales tax, VAT, GST, or similar indirect tax when law requires PLI LLC to do so. The buyer is not made responsible for a filing or remittance obligation that law places on PLI LLC. Checkout may request limited country evidence needed to determine tax treatment.
Prices may change prospectively. A change does not alter an accepted order unless the buyer agrees to a changed scope and price. PartyTopiie sends a durable order confirmation by email and retains a downloadable account copy containing the purchased item, total price, tax, applicable policy versions, and any immediate-performance or withdrawal acknowledgement required by law.
6. Standard Digital Delivery
Standard files may be delivered through an account download, protected download link, delivery email, or another PartyTopiie-approved electronic method. Delivery occurs when PartyTopiie’s systems make the file available or send the applicable access notice.
The buyer is responsible for maintaining a working email address, compatible device and software, and reasonable access to the account or download link. This does not excuse a corrupted, mislabeled, or non-conforming file.
7. Customized Orders
The buyer must provide complete and accurate wording, dates, names, instructions, and a usable photo when required. Photos and other custom material must be uploaded only through the controlled upload area assigned to the order. A buyer must not send them to a fulfillment provider’s personal email, text message, external chat, or personal cloud drive.
The standard delivery target is 24 hours after payment and all required, usable customization material has been received. A purchased rush service has a 12-hour target unless the listing clearly states a different period before purchase.
Customization work begins only when the assigned, authorized fulfillment person first opens, downloads, or otherwise uses the buyer’s material to fulfill the order. Automated receipt, malware scanning, encrypted storage, routing, or assignment alone does not begin the work. The buyer may cancel for a full refund before work begins.
An approved provider may access only the data needed for the assigned order through a controlled PartyTopiie account and only under PLI LLC’s instructions. The provider may not contact the buyer outside approved channels, move data to a personal account, use it for a portfolio or advertising, or submit it to an external AI service.
A provider-caused spelling, personalization, format, omission, or production error will be corrected without charge. A custom order also includes one reasonable preference adjustment within the original purchased scope. A new concept, different product, additional person, substantially replaced instructions, or additional deliverable may require a new order or clearly disclosed charge.
8. EEA and UK Digital Supply
Where EEA or UK law provides a withdrawal or cancellation right, that right applies unless and until it is lawfully lost or an exception applies. Before immediate supply of digital content or immediate performance of a digital service, checkout will request any legally required express request for immediate performance and acknowledgement concerning loss of the withdrawal right, and PartyTopiie will provide the required confirmation in a durable form.
If PartyTopiie cannot provide the tax, checkout, confirmation, withdrawal, conformity, and privacy controls required for a country, checkout will remain unavailable there. This section does not limit a remedy for defective, non-conforming, or undelivered digital content or services.
9. Purchase Protection, Cancellations, and Refunds
The standard administrative window for a Purchase Protection claim is 7 calendar days after delivery or, for non-delivery, after the stated delivery target expires. PartyTopiie normally attempts prompt access restoration, redelivery, correction, or the included preference adjustment when that fully resolves the problem.
If PartyTopiie misses a paid rush deadline for a reason within its or its provider’s control, the rush fee will be refunded. Approved refunds are returned to the original payment method and normally appear within 5–10 business days after issuance. Refunds are not issued as points, rewards, account credit, or another substitute.
The Returns & Refund Policy provides additional terms. No administrative window limits a longer or non-waivable consumer right.
10. Digital Content License
A purchase or Tool export grants a license, not ownership. Permitted personal and small-business physical uses and prohibited digital redistribution, template resale, print-on-demand, stock use, asset extraction, external AI upload, and trademark use are governed by the Digital Content License.
If an order is fully refunded, access may be removed and the license for the refunded files terminates, except where applicable law provides otherwise.
11. Party Tools
Party Tools are interactive features for creating digital design elements. Available features, technical limits, country availability, and any applicable pricing are displayed before use. A Tool output is not a complete invitation, sign, printable, or production-ready layout. The user remains responsible for final size, bleed, resolution, background, supporting text, accessibility, printer settings, and proofing.
Tool inputs are processed transiently on PLI-controlled servers. PartyTopiie does not use a third-party generation service, store Tool inputs or outputs after the immediate request, or send them to an external AI service. Content-free access, error, rate-limit, and security logs are kept for no longer than 30 days.
The user is responsible for Tool inputs and must have the rights and permissions needed for them. Do not enter payment-card information, passwords, government identifiers, medical information, private information about another person, or other unnecessary sensitive data. Tool inputs must not be unlawful, infringing, deceptive, abusive, malicious, or intended to harm the Service or another person.
Exported Tool outputs are governed by the Digital Content License. PartyTopiie does not guarantee that an output is unique, exclusive, registrable, or suitable for every printer, material, jurisdiction, or purpose.
PartyTopiie may offer paid features, usage plans, premium access, or subscriptions. Before charging, PartyTopiie will clearly disclose the price and currency, included features and limits, billing structure, renewal terms if any, cancellation method, refund treatment, and effective date, and will obtain the user’s express payment agreement. PartyTopiie will not charge retroactively for an earlier export or automatically convert unpaid access into paid access. Paid access will be enabled only where applicable payment, tax, privacy, and consumer requirements are supported.
PLI LLC may add, change, suspend, or discontinue a Tool or preset. Where reasonably practical, material changes to a paid feature will be communicated under the applicable paid terms.
12. User Submissions
Submit Your Party is the only authorized public route for submitting party content. The form may be available worldwide only where the privacy, content, sanctions, and consumer controls applicable to the country are ready.
A submission is voluntary and reviewed before publication. It does not guarantee publication, a response, attribution, exposure, points, account credit, cash, discounts, or other compensation. PartyTopiie does not send submission-receipt, selection, rejection, or review-status emails. It may contact the submitter only when clarification, permission verification, a rights or safety issue, or a response to the submitter’s own request makes contact reasonably necessary.
The submitter retains rights they hold but grants the permissions in the User Submission Terms. The submitter must be at least 18 and have all necessary creator, photographer, likeness, privacy, publicity, and parental or guardian permissions.
Published pages use minimal public fields. Each third-party video is click-to-load and does not connect to its video platform until a visitor chooses to load or play that video. PartyTopiie does not send submissions to an external AI service.
13. Reviews, Feedback, and Communications
A review must be truthful and based on a genuine experience. A user may not submit a fake review, impersonate another person, conceal a material connection when disclosure is required, manipulate ratings, threaten or extort through a review, or publish unlawful material.
PartyTopiie does not condition a benefit on positive sentiment. It may remove content that is fraudulent, unrelated, abusive, unlawful, rights-infringing, or technically harmful, but will not prohibit an honest review merely because it is negative.
PartyTopiie displays a review as Verified Buyer only when its own reliable order records verify that the reviewer purchased the reviewed item. A review with an unverified or unknown source will not be displayed as Verified Buyer.
Service and transactional messages may concern an order, delivery, account security, support request, or material policy change. They are not marketing messages.
Users may separately subscribe to promotional emails. Subscription is optional and is not required to place an order, use a Tool, submit content, or request support. Each marketing email provides an unsubscribe method. Unsubscribing from marketing does not stop necessary service or transactional messages.
14. Accounts and Security
A user must provide accurate account information, keep it current, protect credentials, and promptly report suspected unauthorized access. The user is responsible for activity under the account except to the extent applicable law provides otherwise.
PartyTopiie may proportionately restrict or suspend an account reasonably believed to be involved in fraud, infringement, data misuse, abuse, security threats, payment disputes, repeated policy violations, or unlawful activity.
15. Prohibited Uses
A user may not:
- Violate law or another person’s intellectual-property, privacy, publicity, or other rights;
- Upload malicious code or interfere with security, access controls, availability, or another person’s access;
- Scrape, crawl, automate, reverse engineer, bypass Tool limits, overload a Tool, extract protected content or preset assets, or use a Tool to build a competing asset library or service, except with written permission or as non-waivable law permits;
- Collect another person’s personal information without authorization;
- Misrepresent identity, authority, affiliation, product origin, a review, or a submission;
- Divert an on-site order, payment, or fulfillment process off-platform;
- Submit exploitative, abusive, hateful, defamatory, obscene, deceptive, or otherwise unlawful content;
- Use digital content outside the Digital Content License;
- Send PartyTopiie order data, photos, submissions, or other personal information to an external AI service; or
- Circumvent usage, payment, country, sanctions, or technical restrictions.
PartyTopiie may take proportionate action, including content removal, order cancellation, access restriction, account suspension, or termination.
16. Intellectual Property
The Service and its original text, organization, graphics, software, presets, branding, listings, and digital content are owned by or licensed to PLI LLC and are protected by applicable law. No right is granted except as expressly stated.
PartyTopiie permits a digital product, brand or character theme, font, image, or Tool preset to be offered only after its ownership or license basis has been documented and reviewed. PartyTopiie may suspend or remove content in response to a credible rights concern. Complaints are handled under the DMCA & Intellectual Property Policy.
17. Privacy and Cookies
Personal information is handled under the Privacy Policy. PartyTopiie applies privacy choices according to the visitor’s region. In opt-in regions, analytics and other optional technologies remain off until the visitor consents. In eligible U.S. opt-out regions, limited analytics may operate unless the visitor disables it through Privacy choices or sends a recognized Global Privacy Control signal. Essential technologies remain active when needed to operate the Service, and third-party videos on user-submission pages remain click-to-load. See the Cookie Policy.
PartyTopiie does not submit personal information to external AI services for generation, analysis, training, or fulfillment.
18. Service and Policy Changes
PartyTopiie may improve, add, restrict, suspend, or discontinue features. It will provide notice required by law and will not impose a new charge without the express payment agreement described above.
PLI LLC may update these Terms by posting a revised version with a new date and version number. Material changes apply prospectively and may be communicated through the Service, an account notice, or email when appropriate. If applicable law requires express acceptance, continued use alone will not replace it.
19. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” PLI LLC does not guarantee uninterrupted availability, exact display or print color, compatibility with every device or printer, uniqueness of a Tool output, continued availability of an external product, or that general party inspiration is suitable for every event or circumstance.
These disclaimers do not override an express commitment in a listing or policy and do not exclude a warranty, conformity obligation, or consumer right that cannot lawfully be waived.
20. Limitation of Liability
To the maximum extent permitted by law, PLI LLC and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages or lost profits arising from the Service.
To the maximum extent permitted by law, PLI LLC’s aggregate liability for a claim relating to a purchased product will not exceed the amount paid for the affected product. This limitation does not apply to fraud, willful misconduct, death or personal injury caused by legally actionable negligence, data-protection liability that cannot be limited, or any other liability applicable law does not allow PLI LLC to limit.
PLI LLC is not responsible for an off-site transaction between a user and Amazon or the seller identified on the Amazon listing.
21. Indemnity
If a person uses the Service for business purposes, submits content, or provides material that causes a third-party claim, that person agrees, to the extent permitted by law, to defend and indemnify PLI LLC against claims, losses, and reasonable costs arising from their material breach of these Terms, unlawful content, lack of required rights, or misuse of the Service. This does not apply to the extent a claim was caused by PLI LLC’s own breach or misconduct.
22. Mandatory Consumer Rights
These Terms are administered by a United States business. If law applicable to a user provides a consumer, privacy, digital-content, cancellation, refund, accessibility, or other right that cannot be waived, that right controls over an inconsistent provision in these Terms.
23. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law principles. Subject to a non-waivable local right, a dispute may be brought in a state or federal court with jurisdiction in Wyoming.
These consumer Terms do not require binding arbitration and do not include a class-action waiver.
24. Severability and Entire Agreement
If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions continue in effect. These Terms and the policies expressly incorporated here form the agreement governing the applicable Service.
